The question contains an assumption.
That the lawyer makes all the difference.
If she does, might there be something wrong with the justice system in that regard?

Good point, but before Miranda poor people did not receive a lawyer at all. The supreme court ruled that representation does make a difference in court trials and deemed that everyone should get some kind of a lawyer, do you agree with this ruling?
